The General Authority for Regulating the Real Estate Sector (Real Estate) issued the requirements for licensing projects to sell on the map and registering the data of real estate developers, within the framework of activating the provisions of Law No. (6) of 2014 regarding the regulation of the real estate sector, with the aim of enhancing transparency, protecting the rights of beneficiaries and organizing the real estate market in line with Qatar National Vision 2030.
Requirements for licensing projects on the map
To put the units secreted on the map for sale, the developer must submit a request to the authority, with the following documents:
1- A certificate to open the account in accordance with the provisions of this law.
2- Supporting his ownership of the project land, and what is stating that the secretion on the map is completed, explaining all the data of the secreted units.
3- The estimated budget for the project indicating the construction costs and the expected revenues, provided that it is approved by an accredited auditor in the country.
-4- The draft announcement of the sale of units on the map, according to the provision of Article (11) of this law.
5- Contract Model.
-6- Architectural designs and engineering plans of the project are accredited by the competent authorities.
7- A copy of the contract concluded between the developer and the contractor from the subcontractor, if any.
Announcing the sale of units on the map
The administration issues its approval, including the adoption of the draft advertisement and the contract form.
In all cases, the draft advertisement or conditions and provisions mentioned in the contract form may not be changed. It applies regarding the aforementioned request, with the provisions and procedures stipulated in Article (4) of this law.
Register real estate developer data
On the occasion of starting to implement the provisions of Law No. (6) of the year 2014 and its amendments and other relevant laws, the authority, within the framework of the powers granted to it in supervision and supervision and granting licenses to practice for real estate developers.
Accordingly, the developer must provide the authority with all the requirements for the initial registration for sales projects on the map), the most important of which are:
1- Building license.
2 files and license plans.
3- Exposing the real estate units of the project, their prices, area, and facilities.
4- An technical report from the project consultant that includes the stages of the project and the completion of it to date.
-5- A financial report that includes sales agreements and the collected financial flows.
6- A copy of the warranty account agreement signed with the bank in addition to the project account statement.
7- Engineering consultant and financial auditor data.
8- A copy of all the contracts concluded.
9- The contracts of the sales contracts that are concluded with the beneficiaries.
Note that the authority’s judicial seizure team will undertake inspection campaigns to ensure that the provisions of the laws referred to in the coming days are applied.
Sector development and enhancing an investment environment
The General Authority for Regulating the Real Estate Sector «Real Estate» has announced the start of activating the provisions of Law No. (6) of 2014 regarding the regulation of the real estate sector, as part of its efforts to develop the sector and enhance the investment environment in line with the Qatar National Vision 2030.
This step represents a qualitative shift in enhancing transparency, protecting the rights of all parties, organizing the real estate market according to the highest standards, and the initiatives included the launch of the initial registration of real estate developers, the establishment of licensing committees and the resolution of real estate development disputes, and the issuance of instructions for the real estate development warranty account in cooperation with the Qatar Central Bank, with the aim of controlling and organizing the market and ensuring the rights of all parties. To implement the requirements of this law effectively, the authority has created the initial registration of real estate developers and the establishment of the licensing committee, which is concerned with organizing registration and licensing operations according to the highest standards of transparency and discipline. The real estate development disputes committee was also established, to be a specialized platform for a fair and rapid semester in real estate disputes, which enhances confidence between all active parties in the market.
The instructions for establishing a real estate development assurance account were also issued in partnership with the Qatar Central Bank, which obliges real estate developers to open a bank account designated for each project, to ensure the use of buyers ’money exclusively in implementing the project, protecting their rights and enhancing transparency and credibility in real estate transactions.
The decision to issue the decision of His Excellency the Minister of Justice and the Minister of State for Cabinet Affairs relating to the organization of the initial real estate registry and determine its data and procedures and registration fees in it, which will enhance the organization of real estate development and sale projects on the map.
